Lawyer Survey Suggests Law Education Lacks Basics For Creating Practice

In my national survey of lawyers the majority of respondents felt that their formal legal education had not prepared them for implementing legal theory in a business setting. Specifically, they felt they lacked the basics for creating a law practice as well as attracting and interacting with clients in order to develop their business and survive. While they indicate that some law schools are now spending time on the business side of practicing law, respondents also suggest these courses may not be deep enough, comprehensive enough, or given frequently enough.

The consensus is that a soon-to-be lawyer’s business experience needs to be early, hands on, including meeting with clients before the bar exam. It should also involve networking, volunteering, and joining business organizations while students are still attaining their formal legal education. Hands-on experience is necessary for learning communications skills, the psychology of how to interact with clients and the press, using persuasion, and implementing the law in a wide variety of social situations. One large benefit of doing this, and doing it early and often, is that it builds your confidence in a shorter period of time than otherwise. Attempting this later typically take you years of slogging through it all by yourself.

Dealing effectively with people, which is so necessary to your converting prospects to clients, often seems to be omitted from law school curriculum. When it is used, it seems it is often a one-semester course early on which is inadequate. A similar situation has occurred in medical schools where the schools have become aware that their medical students were totally ignorant of what to do in an intake interview with patients. As a result, some schools instituted a first-year course on doctor-patient communication. But now, slowly, the schools are discovering that this interpersonal skills and small talk interview course, with a workshop and peer feedback, needs to be required every year of medical school for both learning appropriate skills, gaining confidence in using them, and making them a habit. Being addressed only once early on is not particularly helpful long-term.

To paraphrase what one lawyer shared on this: Formal education (both undergraduate and graduate) taught me absolutely zero about promoting and presenting myself as an effective and authentic professional. Part of the problem is that when you are still in school, you do not yet fully realize the importance of professional marketing and of interacting with your client as a human being, not just a potential financial transaction. I have learned almost 100% of my promotion and self-presentation skills from other lawyers, other business owners, and family members. My confidence to begin to create profitable visibility and credibility for myself also began there. The upshot is that law school education as it currently stands may be completely useless, except for providing law theory, technical information, and cases. Everything that is worthwhile and works in the real world comes through post-academic experience, which is too bad.

If lawyers, in general, do not learn from their formal training how to market, interact with clients, and create and develop a business-like law practice, how do they work around that obstacle? Most said they did some self-study and figured it out on their own. They read business books and articles and tried to adapt the ideas of the authors to their practice. They realized and embraced the notion that everyone was in marketing and sales in some ways. They learned how to interact with clients from their friends and/or relatives who worked in retail or sales.

One lawyer had a B.A. in English with emphasis in journalism and creative writing that he found helpful to fill in the interpersonal skills’ gap. Another lawyer had an undergraduate degree in linguistics which helped him spot communication problems. And still another had involvement with the financial services business where he could see how to apply marketing mindsets to law practice with emphasis on being the values-based, trusted advisor.

While a formal law education cannot provide everything a practicing attorney will need, it certainly must, at the very least, lay the ground work for the basics lawyers will need to take their education on the road, to set up a practice and run it like a business, and then market and develop it in order to survive.

Managing Technology Within An Organization

I am putting myself to the fullest possible use, which is all I think that any conscious entity can ever hope to do.” – From the HAL 9000 computer, 2001: A Space Odyssey

When it comes to technology solutions for your business it is easy to get carried away with the latest-and-greatest gadgets and solutions. Everyone wants to have the latest shiny thing. In larger organizations, managing technology can become burdensome due to competing and duplicative technology requests. Left unfettered, the company technology platform can resemble a “spaghetti bowl” over time. Often is the case, new technology requests are submitted without any business case to support their investment.

I am a big proponent of having non-technology business leaders play an active role in the determination of the technology solutions utilized at an organization. While it is critical to include an IT perspective from a technical interface standpoint, having non-IT personnel drive technology solutions often lead to decisions based on thebusiness needs of the organization. As such, any technology request would require a business plan to support the investment.

Form A Technology Committee: This is the start of your technology approval process. Create a technology committee that represents various personnel from cross-functional departments. Consider selecting an operations, marketing, accounting, technology and finance member to this team. This committee is charged with creating the process for submitting technology solution requests for the organization as well as providing the prioritization and ultimately, approval of the requests.

Develop A Submittal Process: Inherent in a well-thought through technology strategy for an organization is developing a process for the submission of ideas. Following the “garbage-in, garbage-out” mindset, developing a detailed process for submission will help weed out the “nice to haves” and focus the committee on real, tangible solutions. This process should not only include the technology solution identified, but as importantly, the business case for its justification. For approved projects in the queue, a monthly communication should be sent to the organization recapping the activity of the committee.

Focus Your Projects: A technology committee creates focus throughout the organization. While it would be great to have every new iteration of technology that gets released, that is impractical and costly. The committee can help with providing a high-level perspective on the entire enterprise since it is considering all requests. All to often, departmental requests have a tendency to be created in a silo, with only the impact on that department considered.

Need To Have Vs. Nice To Have: This is a biggie. It is easy to feel that an iPhone 3 becomes obsolete as soon as the iPhone 4 is released, but when the technology is run by the committee, the “nice to haves” usually fail due to a lack of business case. The committee allows the organization to run with an unbiased interference with respect to technology. The committee is charged with improving ROI on technology solutions and since it is comprised cross-departmentally, there should be no “pet” projects.

One Project, Big Picture: I have headed a technology committee in the past and the greatest “aha” moment for me was the amount of similar technology solutions that were being presented from different departments. Had all of these requests been accepted, the organization would have overspent IT dollars as well as created duplicative solutions to the same issues. The committee allows for its members to “rise above” the fray of the organization and view the technology requests in the big picture. The committee’s goal was to ensure that any approved request was accretive to the overall company.

Create A Business Case: This is the best way to clear out the clutter. Ask employees what they need from a technology solution and the committee will be inundated with ideas. Ask them to submit in a business case (cost justification for the investment) along with their solution and ideas are significantly reduced. The business case for a technology solution not only helps in identifying whether the investment is worth it, but also forces the author to think about how this solution interfaces within the existing platform.

Post Analysis: Lastly, carefully measuring the business case proforma against the actual cost/return of the projects not only holds the submitter responsible, but also the committee. The goal with the post analysis isn’t to “call people out”, but rather provide an unbiased financial review of the project. Without this type of post analysis measurement to hold this team accountable, the committee eventually will serve no purpose.

Chronic Pain – Health – Education

Patients will better understand nerve related chronic muscle pain if they understood the burnt pot principle in order to better take care of their own health.

Equivalencies:

New cooking pot: Healthy status.

Cooking in the pot using high heat will burn the food: High-intensity repetitive activities such as sports, recreational and work activities will injure nerves and muscles.

Pot starts to burn: Development of acute pain

When the food starts to burn, stop cooking immediately to cool the pot and avoid more burnt residue buildup: Rest muscles immediately to prevent development of increase in pain.
Immediately clean the pot since it is easier to prevent more and more food from getting burned: Get the acute pain treated immediately and properly until pain is totally resolved. This allows the muscles spasms to be treated immediately and prevents a self-perpetuating cycle of further entrapping intramuscular nerves and blood vessels within the spasm progressing to irreversible nerve damage.

If the burnt residue cannot be completely cleansed, cook using medium to low heat: Avoid high-intensity, high-impact activities and repetitive motion activities which will aggravate the underlying pain due to more muscle tightening and shortening.

If there is significant charring on the cooking surface that cannot be cleansed thoroughly, cooking time before food burns will be much shorter even on using regular heat: If you already have chronic pain, even regular activities of daily living will aggravate the chronic pain. The time before pain is aggravated on performing an activity is much shorter. Moderation of lifestyle is essential.
Continued cooking in a burnt pot wastes a lot of food since the food will stick to the underlying burnt residue: Muscles that are in pain and spasm are shorter in length and cannot perform efficient work. More energy has to be consumed by the muscles to perform a given activity. If the short and tight muscles are worked excessively and unduly, there will be increase in pain.
Cooking time has to be increased by using lower heat to avoid further residue buildup: Patients will have to increase the time to perform an activity. To avoid further pain aggravation movements have to be slower and graduated with frequent rest periods.

Burnt pots are harder to clean needing more effort and energy to clean the char which becomes embedded into the cooking surface: Chronic pain is very difficult to control since nerve damage has become irreversible. More concentrated effort is needed on the part of patient and physician to control the chronic pain.

To be able to continue use the burnt pot, cleaning must occur immediately and regularly after each cooking session: To have quality of life, patients in chronic pain need to have ongoing treatments to immediately and regularly release new muscle spasms that have formed due to activities of daily living. After each treatment session, the areas of new muscle spasm have to be carefully located to restore blood flow to the areas treated.

Social Media Marketing Tips For Small Business

Social networking platforms build buzz, boost business and serve small businesses as low-cost/no-cost marketing tools. Small business owners need to understand how these tools strategically serve and support small business first so they best implement social media strategies to sell products and/or services.

Social Media, simply put, serves users and organizations in marketing in three ways:

1. Communication
Marketing is all about building relationships — relationships start with communication. New web tools like blogging, micro-blogging (Twitter), social networking (Facebook, LinkedIn, Ning), podcasting (BlogTalkRadio), video distribution (YouTube), event coordination tools (Meetup), wikis (Wikipedia) photo sharing (Flickr, Photobucket), and product review sites (epinions.com) allow small businesses to communicate, educate and share information directly with their current and prospective customers.

Content in the form of blog posts, audio, video, comparison/review sites, tweets and social network messages help share information in a less-formal way that builds the know, like and trust factors that influence decision making. Content is no longer just text. Small businesses can use audio or visual content for a “show me” and “tell me” to make communications a pack more interactive punch.

Social media’s direct communication distinction serves and supports small business as it brings the people you want to attract directly to you and makes direct communication possible. Social Media makes communication a conversation so small business owners can share, receive feedback and connect on equal ground with their target markets.

2. Collaboration
When small businesses empower their target consumers, they feel powerful. When your target market feels powerful, it trusts you, buys from you, and stays with you. Social networking collaboration transforms consumers into “prosumers”. In an era of social media prosumers, it’s people (not companies) who make, shape, or break purchase patterns.

Small businesses can ignite collaboration for marketing by creating their own communities and/or joining communities. By doing so, they can listen and connect to their target customers and build a free forum to bring their market together. Collaboration = Marketing Acceleration.

Social networking collaboration tools like review sites, video sharing sites, blogs, wikis and more allow users to self-serve, collaborate, and potentially serve as an endorser for your small business. Social media works as a marketing tool because people are more likely to trust peers rather than companies.

The power of mass collaboration serves and supports small business owners in a distinct way. Tapping/creating valuable collaborative options can bring people together to share ideas, exchange information, and help each other — and support relationship growth. Removing the “company/client” disconnect can break down elitism and boost marketing mind power.

3. Entertainment
The most important reason that social networking works as a marketing tool is simple — because it’s fun. People want to go where they feel they belong, have a voice, are listened to, and enjoy themselves. Small business owners need to be where their target markets are — and these days, the masses are on Facebook, Ning, Twitter, Linkedin, Photobucket, YouTube and more because it has entertainment value.

Remember the Will It Blend? campaigns by Blendtec? They were a perfect example of social media marketing in brilliant action. Videos were relevant as they showed the product, were entertaining (they blended an iPhone!), and they were viral! People could easily share the fun with friends due to the ease of social media sharing widgets.

You can’t put a dollar amount on free promotion. The way social media stores data as an “Interactive Rolodex” also has an entertainment factor. Sites like Facebook and LinkedIn are becoming the “new databases” because they are fast, easy, and fun. People are more likely to update their Facebook and LinkedIn information than a sterile address book because it is fun.

Small business owners use social media’s entertainment factor to build their online database of contacts and connections, be visible to prospective customers, and get the word out in creative ways like YouTube videos, blog posts, images, podcasts to make people smile and spread the word.

How Social Networking Helps Small Businesses Sell
Social Media Marketing helps most small businesses boost sales indirectly by increasing relationships. Understanding that social media marketing serves users for communication, collaboration, and entertainment is the first step to considering how to strategically implement the multitude of social media marketing tools and choose the ones that work best for your unique organization.

The key thing that small businesses need to remember when using social media to help sell is that efforts must have value. There has to be value to your content, community, and execution to get people to engage with you or your organization. Social media doesn’t sell things — people sell things. Engaging in social media marketing starts the relationship-building process. Start small and snowball. Social media takes understanding, passion, effort, and commitment to make it work. Give your small business an authentic voice with social media and commit to providing value and you will be off to a smart start.

Gifts For the 3-Year-Olds

The gifts for the 3 years old are simple to buy and you need not think over the issue for a long time. Here are some basic tips to buy gifts for the 3 years old child:

It is a time for the toddler to grow up and therefore those games are liked by them which have something interesting and intelligible. Children mostly enjoy playing with building blocks. They can make huge structures with the help of these blocks (by arranging the serial orders and also by making small and large homes and sceneries by arranging the blocks).

Brush and clothes: Since the child can have 3 meals and 2 snacks each day, a small packet of exclusive child food can be gives as gift. Milk products are especially beneficial for you child and for this you can give some milk products to your baby. Baby brushes with some attractive toys are perhaps the best gifts at this point of time. The toddler is just learning on how to brush teeth and if you buy him a brush that would be good enough for him. There may be some toys accompanied with the baby brush and perhaps a dress would suffice. The dress material should be of fine cotton so that the baby does not have any problem while using them.

Educational books: You can also give some educational gifts to the three year old child. The educational gifts include books in which numbers are given. The children tend to learn about the number more quickly with the help of these books than with anything else. Since it is the growing age of the child and he or she should learn more due to the pressure from school (yet to be), the digital books are also of great help for the child. From the digital books, the child learns a lot of thins. They can even relate what they have learnt from the books with what they are studying.

Stories: Your child may not take certain foods and become adamant. For these kinds of children the best way is to tell stories while they are having their foods. The best stories for the quiet but attentive 3 year toddler are the educative tales from the bibles and even some of the contemporary tales. The child will not only be interested in those tales but also will be able to relate those tales with their lives. This will help them in future because while they listen to the stories and realize the morals they gain education.

Weekend Backpack – Perfect For a Weekend Getaway

It helps to have a good sized backpack for a camping trip that will take an entire weekend. A weekend backpack is a great option to use among large backpacks for this occasion. This is a type of larger backpack that has plenty of space and is very useful for how easy it can be to carry around for any camping trip.

A weekend backpack is named for how it can be used for a camping trip that can take two nights. This type of backpack is one that is primarily going to be large enough to handle a large amount of materials that will be needed for a weekend camping trip. A typical one of these large backpacks will be at least three thousand cubic inches in size and can be up to five thousand cubic inches in size. Also, one of these backpacks will be only about four to six pounds in weight.

The ability to carry this type of large backpack is very helpful. This type of backpack is going to be longer in length and as a result will need to be carried through straps that attach to the back. Traditional shoulder straps can be used for these large backpacks but torso adjustment features are available on some bags too. The light weight of one of these large backpacks helps too.

Sleeping bag compartments are common features in these large backpacks. This is a type of compartment that helps to store a sleeping bag and is generally found on the bottom part of the backpack. This is used to help with protecting the sleeping bag that will be used during the evenings that one is out on a camping trip.

Also, smaller compartments can be available throughout different exterior parts of the backpack. This is especially helpful for smaller and more fragile camping materials that can be used. Snowboard and ski carrying materials can be used in some of these backpacks too.

A major part of these backpacks is that they are very durable. A typical one of these backpacks will be made with strong padding materials and in many cases HDPE framesheets that have been recycled. Nylon is also used in many different large backpacks like these. Rain covers are used in some of these backpacks to help with protecting the materials in the backpack.

Three Things a Good Skin Product Must Do to Be Really Effective

It’s like clockwork. Every few days a new skin product is launched into the market with a big marketing blitzkrieg, promising to be the be all and end all in skin care. Very few of these actually turn out to be good for your skin, though.

How does one avoid all this hype and choose a really good skin product?

There are three things a cream or lotion should be able to do, to be worthy of your choice. Here they are -

Nourish your skin with essential nutrients
Just removing the signs of damage and aging from your skin is not enough. You need to look for a product that can nourish it from inside out. Remember – to have a beautiful skin, you need to keep it healthy first.

Look for ingredients like Phytessence Wakame and Avocado Oil in your cream. These natural ingredients provide your skin with vitamin B complex, vitamins A and E, and minerals like iron, calcium and potassium. They keep your skin well nourished and healthy and set the stage to make it strong and beautiful from inside.

Keep it safe from skin problems
Dryness, age spots, pimples, and lines and wrinkles are some problems we all face with time. A good product should be able to protect your skin from all these signs of a worn out skin.

Again, natural ingredients like Cynergy TK™ can help you here. This wool extract makes your body produce more Collagen and Elastin inside. An increased quantity of these proteins keeps your skin naturally firm, elastic and wrinkle free. Cynergy TK™ also moisturizes the skin effectively and keeps it soft and supple.

Extrapone Nutgrass root is another natural extract to look for in your cream. It reduces the Melanin content in your skin and makes it naturally light and spot free. The age spots get removed and do not re-occur too.

Provide safe, long term results
This is the key part many people get wrong. While any common skin product can provide some relief from skin problems, it would also cause side effects like allergies and skin irritation due to the chemical ingredients it contains.

By using natural ingredients like the ones we have talked about, you can stop worrying about side effects. Being natural, they are very gentle on the skin and effective too.

Your next step? To take what you’ve learned and find out a good skin product which can do all this for your skin. All the best for your search.

Do a Health Insurance Comparison to Get the Best Deal

It’s clear to see that you need to find some new health coverage. Perhaps your current plan just isn’t cutting it, and you are spending far too much money each month on co-pays and trying to meet your high deductible. Or perhaps you don’t have a health plan at all, and it is simply time to give you that extra security and peace of mind that comes with having health coverage. Regardless of what factors are driving you to get a new insurance plan, you now are in full shopping mode to find the best coverage possible, and this means that you need to do a health insurance comparison.

Shopping around for insurance can quite simply takes days and even weeks to complete as you search for the best policy for you and your family. It can be quite confusing to decipher the terminology used in the insurance world, and then to figure out how those terms and conditions of the insurance will relay to how you will use the insurance plan. After all, not everyone has the same insurance coverage needs, so your health insurance comparison is not as easy as simply selecting the coverage your friends or neighbors have. If you are shopping for insurance, you want to make it as easy as possible to get the information you need for your comparison, and this means making full use of information available online.

Some websites are specifically designed to help you shop around for various coverage plans, and these websites can be a great resource tool for you as you sort through the various plans available. It can be time consuming and even frustrating to sort through the health coverage options, as well as to compare so many options side by side to find the right one for you. But when you use the many tools available to you to make this process easier, you will find that getting the right insurance for you isn’t that complicated at all!
